1. The IRS's New Tax Return Preparer Regulation Plan and Circular 230

(2 hours - Ethics)

This 2-hour course explains the IRS's new plan for regulation of all tax preparers, focusing on the new registration, testing, and continuing education requirements for currently unenrolled preparers. The course also will give an overview of Circular 230, the existing rules of practice before the IRS, which are to be extended to return preparers who currently are not covered by the disciplinary standards. Subjects include:

  • Background on Preparer Regulation Plan
  • PTIN Registration
  • Competency Testing
  • Continuing Education Requirements
  • Overview of Circular 230
  • IRS Disciplinary Actions under Circular 230

2. Tax Research - A Review of IRS Administrative Documents

This 2-hour course provides a review of IRS administrative law. The IRS prepares a dizzying array of administrative guidance documents, each with a different purpose and a different weight of authority. Tax practitioners must be familiar with these pronouncements to properly advise their clients and to ensure that the practitioners have the proper authority for tax positions taken on returns which they sign. This course describes the different types of IRS administrative documents and explains how to evaluate their weight of authority. It also explains how to research these documents and identifies the different sources of this information. Subjects include:

  • IRS Regulations
  • Internal Revenue Bulletin
  • Revenue Rulings and Revenue Procedures
  • IRS Notices
  • IRS Announcements
  • IRS News Releases
  • Actions on Decisions
  • Field Service Advice and Service Center Advice
  • Private Letter Rulings and Technical Advice Memorandums
  • IRS Taxpayer Publications
  • Other Chief Counsel Advice

3. Federal Tax Law Update - Recently Enacted Changes and What's In the Congressional Pipeline

This course is 3 hours in length and will examine the major changes in the Tax Code made during the last year as well as the proposals currently under consideration in Congress. Congress has allowed the impossible to happen. The estate tax is repealed for 20140 and many popular tax breaks have expired. Other major Bush tax cuts, such as the 35% top rate on individuals, are set to sunset in 2011. What is going to happen? This course will explore how and when Congress is likely to act so tax professionals can best advise their clients during this uncertain period. Included are the following enacted or proposed tax law revisions:

  • H.R. 3548, the Worker, Homeownership, and Business Assistance Act of 2009
  • H.R. 4619, the Temporary Extension Act of 2010
  • H.R. 2847, the Hiring Incentives to Restore Employment Act
  • H.R. 4462, 2010 Haitian Relief Act
  • H.R. 3590, the Patient Protection and Affordable Care Act, as amended by H.R. 4872, the Health Care and Education Reconciliation Act of 2010
  • Estate Tax Proposals
  • Tax Extender Bill
  • Bush Tax Cut Extensions
